In 2020, Milton resigned as executive chairman of Nikola following regulatory inquiries. In 2022, he was found guilty of securities and wire fraud. Milton and his wife donated more than $3.2 million to Donald Trump's 2024 presidential campaign and figures in Trump's orbit. In March 2025, he was given a full pardon by President Donald Trump. As a result of the pardon, Milton will not need to compensate Nikola shareholders, who lost tens of millions of dollars. In September 2025, the SEC under the second Donald Trump administration dropped civil enforcement cases against Milton. As a consequence, Milton will not have to pay any civil penalties or face job restrictions, allowing him to work in security-related positions.
